Adam Roberts reports for KHBS 40/29 News that Arkansas prosecutors have charged Nancie Michelle Givens, the former executive director of the state’s Office of Professional Programs, with 65 felony counts of tampering with a public record. The Arkansas bar exam case covers test sittings from July 2020 to July 2025. According to the Arkansas Supreme Court’s release, some scores were allegedly nudged over the passing line, at least one passing score was allegedly dropped to a fail, and one examinee allegedly lost the top score to someone else.
These are charges, not convictions. Still, think about both ends of it: someone may have been admitted who didn’t pass, and someone who did pass may have changed careers after a fail they never earned. The court’s conduct office is contacting people who may have been affected. Arkansas lawyers watching this play out can see who’s hiring on our Arkansas legal jobs page.
As KHBS puts it: “The news release states that evidence points to Givens taking points away from some test-takers’ scores and adding them to others. Some test scores were raised above the minimum needed to pass.”
