Perfecting the Document Destruction Policy

Three attorneys at Edwards & Angell have put together an article on issues to consider when drafting a records destruction policy.  According to the attorneys, a well-drafted policy should address the following issues:

"• Regularly scheduled purging that adheres to administrative and regulatory time requirements.

• Provisions for the regulation of both paper and electronic records.

• Provisions for the cessation of document destruction when litigation or government investigations are pending or anticipated."

The authors also run through a number of other tips that should prove useful to in-house counsel dealing with document destruction policies.
