The Federation of European Direct Marketing reports that, after four years of negotiation with seven international business associations, the European Commission has approved standard contractual clauses that companies can utilize(commencing April 1, 2005) to provide a legal basis for the transfer of personal data to entities outside of the EU.
Practitioners can download model clauses from the FEDMA website, and can also view the EU’s Press Release and FAQ.
The EU Data Directive strictly controls the flow of personal data in the EU and its effects have reverberated through the United States.
