D&O Insurance: Saddle Up The GCs

Doernberg’s D&O Reporter discusses an article that may put another to do item on the desks of general counsel everywhere – making sure that D&O insurance policies provide appropriate protection:

"…D&O insurance is much too important to leave to the insurers and brokers. The article suggests that, among other things, there is a dearth of talent in the area of policy drafting, and that GCs need to get involved in order to make sure that their companies are getting the insurance coverage they should. As one participant in the conference noted, D&O policies contain many meaningless phrases, but it is the lawyers who have to live with the policy language if there is a dispute."
